These Terms of Use (“Terms”) govern your access to and use of opendsr.com and related sites, applications, content, learning portals, certification programs, events, and services (collectively, the “Services”) operated by Amol Londhe Consulting (“OPENDSR,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy and Cookie Notice (together, the “Agreement”). If you do not agree, do not use the Services.

2. Eligibility & accounts

Minimum age. The Services are intended for individuals 16+ (or the age of digital consent in your jurisdiction).

Account registration. You must provide accurate, complete information and keep it updated. You are responsible for all activity under your account and for safeguarding your credentials. Do not share, sell, or transfer your account.

Institutional access. If your access is provided by an employer, school, or partner, additional terms may apply between you and that organization.

3. License & acceptable use

Limited license. Subject to the Agreement, we grant you a personal, revocable, non-exclusive, non-transferable license to access and use the Services for non-commercial learning and certification purposes.

Prohibited uses. You agree not to:

1. copy, record, scrape, spider, or bulk-download course content;
2. share answers, exam content, or proctoring materials;
3. circumvent security or DRM;
4. reverse engineer or interfere with the Services;
5. upload malware or attempt unauthorized access;
6. impersonate others or misrepresent credentials;
7. use the Services for unlawful, harmful, or infringing activity.
8. Fair usage. We may apply limits to prevent abuse (e.g., bandwidth, API calls, automated queries).

4. Course content, exams & certifications

Content ownership. Courses, videos, text, questions, images, templates, certification designs, badges, logos, and all associated IP are owned by OPENDSR or its licensors and protected by law.

Your learning license. Enrollment grants you a limited right to view/use content solely for your learning during the access period specified at purchase or enrollment. No resale, redistribution, public display, or derivative works without written permission.

Honor code. You will complete assessments honestly, without unauthorized assistance, and will not share exam questions, answers, or proctoring footage.

Proctoring & ID checks (if applicable). Certain certifications may require identity verification and online proctoring (see the Privacy Policy for details). Failure to comply may result in invalidation, suspension, or termination without refund.

Certificates & badges. Issuance is at our discretion based on completion and assessment criteria. We may verify, revoke, suspend, or correct certificates for integrity, policy breaches, or error. Public verification services may display your name, certificate ID, and status.

Changes. We may update curricula, question banks, formats, pass marks, or issuance rules to maintain quality and integrity.

5. User content & feedback

Your content. If you submit posts, assignments, messages, reviews, or other content (“User Content”), you retain ownership but grant OPENDSR a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and distribute such content for operating and improving the Services.

Responsibility. You are solely responsible for your User Content and warrant you have the necessary rights and that it does not violate law or third-party rights.

Moderation. We may remove or refuse content at our discretion.

Feedback. If you provide ideas or suggestions, you grant OPENDSR a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

6. Pricing, payments, refunds & taxes

Pricing. Prices, features, and access periods may change from time to time. Taxes and fees may apply and will be shown at checkout where possible.

Payments. Payments are processed by third-party providers. We do not store full card numbers.

Refunds. Unless otherwise stated on the product page or required by law, all sales are final once content is accessed or a certificate attempt has begun. Where offered, time-bound refund windows or satisfaction guarantees will be honored as posted at purchase.

Subscriptions & renewals. If you purchase a subscription, it will auto-renew at the then-current rate unless you cancel before the renewal date. You can cancel in your account settings; access continues until the end of the paid term.

Discounts & trials. We may offer promotions or trials with special terms, which will apply in addition to these Terms.

7. Third-party services & links

The Services may integrate or link to third-party sites, tools, identity providers (SSO), analytics, video/CDN, or proctoring vendors. We are not responsible for those providers. Their terms and privacy policies govern your use of their services.

8. AI-assisted features (if enabled)

We may offer AI-assisted search, drafting, Q&A, or recommendation features. AI outputs can be inaccurate or incomplete and are provided “as is” for guidance only. You are responsible for independently verifying critical outputs and for any decisions you make based on them. Do not submit confidential or sensitive information unless the Service explicitly supports it.

9. Intellectual property

Ownership. The Services and all content, trademarks (including OPENDSR and associated logos), design marks, and software are the property of OPENDSR or its licensors.

No implied rights. Except for the limited license in Section 3, no rights are granted by implication or estoppel.

Notice of infringement (DMCA / similar). If you believe content infringes your rights, send a notice to legal@opendsr.com
 with: (a) your contact details, (b) identification of the work claimed to be infringed, (c) the allegedly infringing material and its location, (d) a statement of good-faith belief, and (e) a statement that the information is accurate and you are authorized to act. We may remove or disable access in our discretion.

10. Privacy & cookies

Your use of the Services is subject to our Privacy Policy and Cookie Notice, which explain what data we collect, why, and how you can exercise your rights. By using the Services, you consent to our data practices as described there.

11. Service changes, availability & support

Changes. We may add, modify, or discontinue features, courses, or certifications (including beta features) with or without notice.

Availability. The Services may be unavailable due to maintenance, outages, or events beyond our control.

Support. Unless a separate written agreement states otherwise, support is provided on a commercially reasonable basis and without uptime or performance guarantees.

12. Termination & suspension

By you. You may stop using the Services at any time. If you delete your account, we may retain certain data as described in the Privacy Policy and as required by law.

By us. We may suspend or terminate access immediately if you breach the Agreement, threaten security or integrity, engage in fraud or cheating, or as required by law.

Effect. Upon termination, your license ends and you must stop using the Services. Sections intended to survive (e.g., IP, disclaimers, limitations, indemnities, governing law) will continue.

13. Disclaimers

Educational use only. The Services and content are provided for learning and professional development and do not constitute legal, financial, HR, medical, or other professional advice.

“As is.” THE SERVICES, CONTENT, AND AI FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No guarantee of outcomes. We do not guarantee that completing a course or earning a certificate will achieve any specific result (e.g., job placement, promotion, compliance).

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENDSR AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, LICENSORS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO OPENDSR IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD 100.

Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the fullest extent permitted.

15. Indemnification

You agree to defend, indemnify, and hold harmless OPENDSR, its affiliates, officers, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the Services, (b) your User Content, (c) your violation of the Agreement or law, or (d) your infringement or misuse of third-party rights.

16. Export control & sanctions

You represent that you are not located in, or a resident of, any country or region subject to comprehensive sanctions and are not on any restricted party list. You will not use the Services in violation of applicable export control or sanctions laws.

17. Governing law & dispute resolution

Governing law. These Terms are governed by the laws of India.

Venue / arbitration. Disputes will be resolved [Choose one: exclusively in the courts of Pune, India / via binding arbitration under the rules of (e.g., SIAC/AAA) with seat in (City, Country)]. You and OPENDSR waive any right to a jury trial where permitted.

Injunctive relief. Nothing prevents either party from seeking injunctive or other equitable relief for actual or threatened infringement, misappropriation, or violation of IP or confidentiality rights.

18. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change, and we may provide additional notice where required. Your continued use after changes become effective constitutes acceptance of the revised Terms.

19. Miscellaneous

Entire agreement. The Agreement is the entire understanding between you and OPENDSR regarding the Services and supersedes prior communications.

Severability. If any provision is unenforceable, the remainder remains in effect.

No waiver. Failure to enforce a provision is not a waiver.

Assignment. You may not assign the Agreement without our prior written consent. We may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.

Notices. We may send notices via the Services, email, or your account contact information. You must keep your contact details current.

Force majeure. Neither party is liable for delays or failures due to events beyond reasonable control (e.g., internet or utility failures, natural disasters, war, strikes, governmental actions).
